The DLR federation has just published for its members a "model contract for the provision of equipment operation services by a self-employed contractor on behalf of a rental company". This model contract meets a specific need of equipment rental companies, with the aim of contracting with some of their service providers in complete transparency, and thus securing their legal environment. The aim is to ensure that all interactions between the rental company and the service provider are clearly defined, thereby minimizing the risk of misunderstandings or disputes. The 13 articles of the contract detail the obligations of both parties, the nature of the services, the duration of the contract, as well as prices and payment terms. The contract also covers liability issues, notably in the event of equipment misuse or failure to comply with safety conditions, and specifies the procedures for dealing with breakdowns or damage to equipment. The contract is intended to be exhaustive, covering aspects such as personal protective equipment, daily checks, etc.
